MARRIAGE LICENSES

Except for a few exceptional circumstances, both parties must appear together in person at the Office of the Town Clerk in order to obtain a marriage license. The couple must complete and sign under oath an Intention of Marriage which states that there is an absence of any legal impediment to the marriage. Each party must provide the following information: present full name, surname after marriage, date of birth, age, occupation, residence, intended residence after marriage if not a Massachusetts resident, status of previous marriages/civilunions/domestic partnerships if any, birthplace, name of mother/parent (including maiden name if applicable), name of father/parent, sex, blood or marriage relationship (if any) to each other, social security number. The fee for filing the Intention of Marriage is $50.00.

Persons seeking a marriage license must be at least eighteen years old or have a court order providing for an exception. As of January 28, 2005 premarital blood tests are no longer required in Massachusetts.

Massachusetts requires a mandatory three day waiting period from the time the Intention of Marriage is filed before a Marriage License can be issued. A waiver from this period may be obtained from the local District Court. A marriage license must be used within sixty days from the date of filing the Intention of Marriage and may be used for a ceremony conducted in any Massachusetts city or town. The member of the clergy or Justice of the Peace who performs the ceremony must sign the license and return it to the city or town where it was issued.


SOLEMNIZE/CLERGY

If an out-of-state member of the clergy is to perform the marriage, the clergyperson must obtain a Certificate of Authorization from the Massachusetts Secretary of the Commonwealth prior to the ceremony. This certificate, which is issued by the Public Records Division of the Secretary of the Commonwealth, is to be attached to the original license and returned to the clerk of the city or town where the license was issued. DBA CERTIFICATION

All business certificates (commonly known as "doing business as" or "DBA" certificates) are filed with the Town Clerk. The DBA files allow consumers to identify and locate the proprietor of a business that goes by a name other than that of the proprietor. Once filed, a certificate is valid for four years. The fee for filing is $75.00

TRANSFER STATION PERMITS

Transfer station permits and stickers are required for every vehicle that transports refuse to the Winchester Transfer Station. Residential permits are issued to residents only, and may be purchased for any or all vehicles registered to residents living in the same household. Permits are required for every vehicle that transports rubbish to the Town’s Transfer Station.
Applications for permits are mailed to every household in January with the annual census. New residents may apply for a permit at the Town Clerk’s Office.

ELIGIBILITY FOR REDUCED FEE TRANSFER STATION PERMITS

The Town of Winchester announces the eligibility requirements to obtain a low-income transfer station permit.  Low Income Permits are available for residents who qualify at a cost of $30.00 per household.  Only one sticker shall be provided.  Citizens must provide proof that they are eligible for fuel assistance, through the Tri Community Action Program, Inc. as a qualifying factor. 


* A signed 2013 census form, to prove residency and size of household.

* A copy of “Eligibility Notification” for the 2012-2013 Fuel Assistance Program from Tri-Community Action Program, Inc.

OR

* Income tax returns, bank statements, social security statements, pay check stubs, or any other evidence that shows the total combined income for all family members.

Highlights of the Town of Winchester Leash and Animal Litter Laws:
* All dogs must be vaccinated against rabies, and licensed at 6 months of age.
* All dogs must be licensed every year. Dog owners are subject to fines of up to $50, if dogs are not licensed.
* A 24-hour leash law is enforced.
* Owners of dogs that produce nuisance barking, howling, and/or biting will be subject to citation and fine.
* No person shall keep more than 3 dogs over the age of 3 months.
* No kennel licenses are permitted
(Code of By-Laws, Chapter 10)
* All animal litter left on sidewalks or on public property, or on private property not owned by the dog owner, must be removed and disposed of in an appropriate manner.
* Dog owners are subject to fines up to $150 for non-compliance with this by-law.

Dog license applications are mailed to each household during the month of December every year. The deadline to license dogs is April 15. Dogs may be licensed at the Town Clerk’s Office Monday through Friday from 8AM to 4PM. For each license the following is needed:

1. Current rabies vaccination certificate showing the expiration date.

2. $20 for each dog if it has not been spayed or neutered.
$15 for each spayed or neutered dog.
(Certificate of spaying or neutering is required, if not already on file with the Town Clerk.)


RAFFLES AND BAZAARS

Nonprofit organizations in existence for more than two years, that are either veterans' organizations chartered by Congress; church or religious organizations; fraternal or fraternal benefit societies; educational or charitable organizations; civic or service club organizations; or a club or organization operated exclusively for pleasure, recreation and other nonprofit purposes, where no part of the net earnings inures to the benefit of any member or shareholder, may apply to the Town Clerk to conduct a raffle or a bazaar.
A raffle is an arrangement for raising money by the sale of tickets, certain among which, as determined by chance after the sale, entitle the holder to prizes. A bazaar is a place maintained by the sponsoring organization for disposal by means of chance of one or both of the following prizes: (1) merchandise of any value, (2) cash awards, not to exceed $25.00 each. The fee to file an application to conduct a raffle or a bazaar is $20.00.
